Rental Agreements

Expectations

All rental agreements are entered into by the tenant(s) and Sierra Vacation Rentals a.k.a. Big Trees Real Estate, Inc. “Property Manager”, regarding the individual properties. Rental properties are owned by individuals. Tenants agree to respect the individual properties. Tenants are expected to leave the rental properties in the same condition as they were in at the time of rental. Owner or owner’s agents are not responsible for power outages or failure of water systems.

PLEASE NOTE: During holiday periods, there is a 3-night minimum stay for all of our cabins. Thanksgiving Weekend,  Mid December through the first week of January, Martin Luther King Weekend , President's Day Weekend, 4th of July all have 3-night minimums. Other holidays may also apply. 

Long Distance Phone Calls

All long distance telephone calls are to be made by calling card or by reverse charges (collect) only.

Parking and Snow Removal

Each furnished cabin provides off street parking for two cars. Snow removal will be provided per owner’s contract with sub-contractor. Snow removal will be limited to 2 off-street parking spaces. Absolutely No on-street parking is permitted during snow removal activities, failure to comply with this Ordinance will result in the towing of your vehicle by the Calaveras Sheriffs Department, with all costs (bail, towing, & storage) the responsibility of the vehicle owner.

Trash Policy: All trash is to be removed from the cabins upon departure. Trash may be deposited at Avery Refuse Disposal Site at no fee. Tenants will receive a supplemental bill if excess trash is left in the cabin - subject to $5.00 per bag. 

Linens, Paper Products
Washable linens are to be provided by tenants with the exception of units providing linens. Paper products are to be provided by tenants.

Arrival Times: The normal check-in time is 4 p.m. Tenants should contact Sierra Vacation Rentals if they need to check in later. Tenants should check emails for special access arrangements if needed. Check out time is 10:00 a.m. Late checkout is possible if available, but please note: Late check-out without prior approval will result in a 1/2 day charge to Tenant. Tenants are obligated to the cabin booked. There will be no substitutions.

Changes to Reservations by Sierra Vacation Rentals (Big Trees Real Estate, Inc.): Sierra Property Rentals reserves the right to change, cancel or move the guest to a comparable cabin when deemed necessary due to circumstances beyond our control. Guests will be notified prior to arrival, when possible, of any change to the reservation. Sierra Property Rentals is only liable for the return of deposits and any prepaid rents.

Cancellation Policy: If cancellation occurs, forfeiture of deposits resulting from cancellation are as follows: 30 days notice =$50.00  29-15 days notice = $250.  Notice of 14 days or less= full rent amount. Should the property re-rent without any loss of days, there will be a full rent refund, minus a $50 cancellation fee. No refunds will be made due to electric power outages. No refunds will be made due to weather conditions unless highway closure denies access to the cabin. In the event of cancellation, Sierra Vacation Rentals will retain the $50.00 processing fee in addition to the cancellation fee. Tenant will pay $25 for each rent check returned due to insufficient funds.

Date Change Requests: Any date change requests from the original reservation made are subject to a non-refundable $25.00 rebooking fee per date change request.

Property Damage: All cabins have mandatory cleaning. Tenant will receive a supplemental bill (Or charge to their credit Card) if there is damage to the exterior/ interior of rented cabin or damage/breakage of owner’s personal property and/or the home or cabin is found to require excessive cleaning beyond what is normally expected. Upon your arrival, please take a visual check around the cabin. Let us know if you see any major problems that might have been overlooked.

Cleaning Fee: Cleaning fee will restore the property to a professionally cleaned condition after your departure. Not Including: returning any furniture that has been moved, washing and putting away dishes, washing and putting away linens used at non-linen properties, etc.

Pet-Friendly Cabin Policy: To bring any pet to a Pet-Friendly cabin, the Owner and Agent must Approve the pets beforehand. No cats or puppies (under the age of 1 year) are permitted in any property at any time. There is a limit of 2 dogs in any pet-friendly rental. No Exceptions to this policy. Any Tenant who does Not follow these procedures will forfeit their deposit & their contract will be Null & Void. Pets are not allowed on furniture at any time during your stay. Pets are not permitted to be left alone or unsupervised in any pet-friendly rental. Tenant is responsible for pet waste cleanup. If furniture, carpets etc. are soiled by pets, the tenant will be responsible for professional upholstery/carpet cleaning costs or replacement of furnishings if deemed necessary. Agent reserves the right to charge a $25 per pet fee for Pet-Friendly cabins.

Rental Protection Fee: The Rental Protection Fee is a non-refundable fee (only refundable if reservation is cancelled at least 24 hours prior to arrival date) charged for each booking. Our company (including the participating rental property homeowners we represent) is a participant in a Property Protection Program that covers certain costs for unintentional accidental damage to our properties during their rental occupancy, provided they are disclosed to management prior to check-out. Any damages that exceed the program limit will be charged to the tenant’s credit card on file.

Cabins are inspected prior to and after each use.  Tenant is liable for any and all damages or additional costs incurred during their stay. If, during a tenant’s occupancy, the tenant or a member of tenant’s party or tenant’s guest causes any damage to real or personal property of our rental property as a result of unintentional accidental acts or omissions, the tenant must notify Sierra Vacation Rentals property management office at that time, and prior to check-out.

Tenant is liable to us for any damages caused by the tenant or a member of tenant’s party or tenant’s guest that exceed the maximum per-incident limit of our program, and the credit card on file and/or any collected security deposit will be charged. Big Trees Real Estate, Inc. reserves the right to charge special or large event and/or pet deposits in certain situations.

 

Tenant Agrees To:

1. Keep the premises clean and sanitary and to properly dispose of all garbage and waste.

2. Not to disturb, annoy, endanger, or interfere with other occupants of neighboring cabins.

3. Not to use the premises for any unlawful purpose, violate any government ordinance or create a nuisance.

4. Not to destroy, damage or remove any part of the premises, equipment or fixtures or commit waste or permit any other persons to do so.

5. Not to keep pets on the premises without the express permission of the Manager.

6. All properties are Non-Smoking. No smoking is allowed inside or out. If smoking does occur on the property, the tenant forfeits the right to any security deposit refund and is responsible for all damage caused by the smoking, including but not limited to removal of stains, burns, odors and any replacement of furnishings damaged by smoke.

7. No campfires are allowed on the properties.

Tenant agrees to hold Landlord/property owner harmless from claims, demands, damages, or liability arising out of the premises caused by or permitted by Tenant, Tenant’s family, agents, employees, and guests.

If an action is instituted to enforce this agreement, the prevailing party shall receive reasonable attorneys fees. Advanced bookings are subject to new rate schedules if rates are increased.

Tenant will pay minimum $300 at the time of reservation in order to hold the reservation and balance at least 30 days in advance of the arrival date.
